What is a military expert witness?
A military expert witness provides professional analysis and testimony in legal cases involving military personnel, practices, benefits, operations, or regulations. Our experts help clarify military-specific concepts such as promotion timelines, injury impacts, retirement benefits, and service obligations. We also can help clarify military policies, laws that impact the military, command obligations, military roles and responsibilities, deployment, training and combat operations.
In what types of cases are military expert witnesses used?
About half of our cases involve personal injury of some kind and the potential impact that the injury has on a service members career. We assist in personal injury, wrongful death, and insurance defense cases involving active-duty service members, and Reserve and National Guard members, from every military service and the Coast Guard. Other types of cases vary but also have a military connection of some kind. These can involve military training, combat operations, military equipment, or command responsibilities. We can provide superb references across multiple cases, if needed.
Do you work with defense attorneys or plaintiff attorneys?
Both. We offer unbiased, fact-based opinions and have supported defense firms, plaintiff attorneys, and insurance carriers in a wide range of civil litigation matters involving military clients. We approach the personal injury cases with a common framework that first looks at the service members’ career to see if the injury had a realistic impact on their career progression. If the answer is yes, we then have proven financial models that can calculate the financial impact of the career disruption with a high level of confidence and precision.
How do you calculate military career and compensation impacts?
We use proprietary financial models, current military pay charts, promotion board experience and standards, and retirement system knowledge to evaluate the projected financial impact of injuries, separations, or other disruptions to a service member’s career.
