We completed a project where the service member was injured in a car accident at a major fast-food chain, and his injuries potentially limited his ability to serve. This placed into question his ability to finish his military career and receive his retirement pay and health care benefits. This project required an expert review of his promotion potential, relevant military policies, and regulations, understanding the military’s health and disability regulations and process, a calculation of expected pay and health benefits over time and an expert opinion regarding the financial impact his injuries had on his service. This multi-million-dollar case was successfully settled, and our work resulted in a substantial adjustment of the payout.
We were retained by the Attorney General of the State of Washington, to provide expert assistance in a case where they were sued by a Soldier who was arrested, and claimed the state improperly arrested him, damaging his career. We were able to look holistically at the Soldiers career and actions and the due process afforded the Soldier. Based partly on our work, the judge dismissed the Soldiers complaint.
We were retained by a global insurance company to assist in litigation related to the 3M Ear Plug multi-district litigation. We were retained for our expertise in pre-combat training and the role of commanders in preparing their units for combat and testified successfully in front of a tribunal in London. We have since been retained by other insurance companies involved in similar litigation.
We have also served as an expert witness in a case that involved a Service Member being injured in a traffic accident, who filed a damage/injury suit against the trucking company involved in the accident. We represented the trucking company. The Service Member claimed the accident caused her to be medically separated from service and reduced her potential retirement pay. We were able to show that the Soldier’s expert witness dramatically overstated her economic injury and in fact, the Solider was not harmed economically by the separation. The attorney notified us that the case successfully settled and stated that our work was “terrific” and “helped get this settled at a reasonable level”.
We were retained by the plaintiff’s attorney and provided testimony in a defamation case against a major global media firm, where the Plaintiff received a multi-million-dollar settlement, after the jury had found the media company liable. The facts of the case revolved around evacuating U.S. citizens and Afghan Nationals from Afghanistan, during the 2021 US withdrawal from that country. MG Young helped start a non-profit that evacuated over 2500 individuals from Afghanistan and MG Young personally case managed approximately 20 of these individuals. His understanding of the situation on the ground in Afghanistan, the tradecraft involved in evacuations, and the cost of such operations was important for the plaintiff to make his case.
We worked as an expert on behalf of the insurance carrier and transportation firm, who was involved in litigation by a Naval Officer who had been injured in an automobile accident. The officer claimed the accident derailed his next promotion and was responsible for loss of income and retirement pay. We were able to review his records, explore the necessary background, and show the officer had already been passed over for promotion before the accident. This finding caused the opposing experts to modify their report.
